Purchasing and Returns Policy

Manor Born Estate Sales, Inc.  (the “Company”) and its service providers (collectively “us,” “our” or “we”) operate a service and solution that enables and supports estate sale agent members (“ES Members”) with conducting online and mobile transactions with customers involving the sale and purchase of items being sold by ES Members via an estate sale (the “Solution”).  The Solution may be available through our website located at https://www.manorbornestatesales.com or via a mobile application, with certain back-office and support services hosted and available separately.  This policy, along with the content of our then-current Terms of Use agreement and such invoice, statement or other document as we may provide or require, governs each transaction for the sale by ES Members and purchase by customers of estate sale items (“ES Items”) via the Solution.

Prices and Payment.

All transactions for the purchase of ES Items are ultimately between the ES Member that listed the ES Item and the customer that purchases the ES Item, with the Company simply providing the Solution as the platform for facilitating such transaction.  All prices quoted or posted for ES Items through the Solution are subject to change without notice. The price charged for an ES Item will be the price in effect at the time that the order is placed by the customer using the Solution and will be set out in your order confirmation message and invoice. Price increases will only apply to orders placed after a price change is first made. Posted prices do not include taxes, duties or charges for shipping and handling and insurance. All such taxes and charges will be added to your ES Items order invoice subtotal and will be itemized in a customer’s shopping cart and in your order confirmation message and invoice. We are not responsible for pricing, typographical or other errors in any offer posted on the Solution, and we reserve the right to cancel any orders arising from such errors.  Terms of payment are as further specified with the Solution and, unless otherwise agreed by us in writing, payment must be received by us before an order is to be deemed accepted. We accept PayPal, Visa, Mastercard, Discover and American Express for all purchases.

For ES Members, fees withheld and amounts to be paid shall not be calculated and deemed final unless and until the order has been fully fulfilled and payment received and is exclusive of all transaction processing fees and amounts, shipping and handling charges, refunds, returns, taxes and other commissions.  You represent and warrant that (i) the credit card and/or banking information that you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card presented for the purchase, (iii) if an ES Members, your bank account is available for the receipt of, and the refund of, payments, (iii) charges incurred by you will be honored by your credit card company and bank, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes and other expense amounts applicable to the transaction.

Shipments; Delivery; Title and Risk of Loss.

The Solution may provide for the selection by customers of a method of shipment for each ES Item purchased via the Solution.  ES Members are solely responsible for coordinating arrangements with shippers for each ES Item purchased via the Solution, with the purchasing customer being solely responsible for coordinating arrangements with shippers for ES Items, if any, being returned.  Customer will pay all shipping and handling charges specified during the ordering process.  Arrangements for the shipping of all ES Items purchased through the Solution must be completed as soon as possible but in no case later than such date that the ES Member is obligated to complete the applicable estate sale and remove all items from the estate.  Risk of loss or damage to a purchased ES Item is with the ES Member during such time as the item is in the possession of such ES Member, with the customer assuming the risk of loss once the ES Item has been delivered or picked-up by the shipper.  Order, shipping and delivery dates provide are estimates only and cannot be guaranteed. The Company is not liable for any delay in shipments.

Returns and Refunds.

All sales are final.  We offer no refunds on any ES Items designated on or provided through the Solution, and all such items are non-returnable.  Notwithstanding the foregoing, in the event that a circumstance should arise where the selling ES Member, in its sole discretion, determined to permit and process a cancelation, refund, return or credited back for a transaction, you will need to contract that ES Member directly to make arrangements for the return and refund, with the same payment method used to make the original purchase possibly being be used (but not necessarily being used) for the refund.

Compliance with Laws and Personal Use.

With regard to all transactions involving ES Items and your access and use of the Solution, you agree to comply with all laws and regulations of the various applicable states and of the United States and that the Solution (and each transaction) is intended to comply with the laws and regulations in the United States.  The laws and regulations of other jurisdictions may be different and offers for ES Items made through the Solution are void where prohibited by law.

Force Majeure.

We will not be liable or responsible to you, nor be deemed to have defaulted or breached this Policy or any other applicable agreement with you, for any failure or delay in our performance when, and to the extent, such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting service providers (including shippers and carriers) or inability or delay in obtaining supplies of adequate or suitable goods, materials or telecommunication breakdown or power outage.

Changes and Updates to this Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions of this Policy at any time for any reason, and we may notify you of such changes through any of a variety of means, including a change to the “Last Updated” date set forth above and other reasonable means to be determined at our discretion. All changes shall be effective immediately. In the event of a material change that may directly affect an order placed through the Solution, we will notify you via the most recent e-mail address that you have provided to us in conjunction with your account. Please check this Policy periodically for changes. Your continued access or use of the website, application or Solution after the posting of changes constitutes your binding acceptance of such change.
