Manor Born Estate Sales, Inc.  (the “Company”) and its service providers (collectively “us,” “our” or “we”) operate a service and solution that enables and supports estate sale agent members (“ES Members”) with conducting online and mobile transactions with customers (the “Solution”).  The Solution may be available through our website located at or via a mobile application, with certain back-office and support services hosted and available separately.  This policy sets forth our privacy related practices and procedures as such are applicable to ES Members, customers and such other persons and entities that are users or guests of our website or applications (collectively or individually “you” or “your”). This policy applies to and governs the information and materials that you provide or that we learn from your access or use of the Solution, website or application and tells you how we collect, use, and in some instances share, this information and material.

The Information Collected

Personal Information: You may provide us with what is generally called “personally identifiable” information when you access or use the Solution, such as your name and e-mail address. In addition, we may give you the option to provide certain demographic information or other personally identifiable information about yourself.

“Cookies” Information: When you visit the website or an application or use or access the Solution, we may send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer.  We use both session cookies and persistent cookies. A persistent cookie remains after you close your browser and may be used by your browser or operating platform on subsequent visits to the website, applications or Solution. By using these cookies, the Company and its affiliated ES Members and service providers can “remember” what you have done on the Solution before and personalize our website, applications and Solution for you. These persistent types of cookies can be removed. Each web browser implements different functionality, so please refer to the manuals or technical support resources that are available in conjunction with your web browser or operating platform to learn the correct way to modify your cookies set-up. If you are accessing or using the website, applications or Solution in a jurisdiction where your prior consent is required for us to deploy any particular cookies, you will be asked to accept such cookies before they are deployed. Please note that disabling cookies or declining to accept certain cookies will prevent you from accessing some of the functionality and offerings available via the website, applications and Solution.

“Automatically Collected” Information: When you visit the website or applications, access or use the Solution or open one of our emails or other forms of message, we may record certain information from your web browser or operating platform by using different types of technology, including “clear gifs” or “web beacons.” This “automatically collected” information may include your Internet Protocol address (“IP Address”), dates and times of access, web browser or operating platform type, and features, pages or sites that you visit while on, as well as just before or just after you were on, the website, applications or Solution.

Payment Information: If you are involved with the purchase of a product or service through the Solution, we may collect shipping, billing, payment and/or other information necessary to process the applicable transaction. We may also receive the credit card, bank account and/or other payment information, such as PayPal account information, that you provide.

Customer Support Correspondence: When you ask for assistance for support purposes, we will also collect and store the contact information that you provide (generally your name and e-mail address), information about your activity on the website, application or Solution, and your user ID number. We may also record and store the communication that you provide and any information contained within.

Uses of Information

We use the information and materials that we collect to provide all of the features and services found with and on the Solution. We may use your email address for marketing purposes, unless you have expressly notified us that you prefer for us not to use your email address for any specific marketing purposes (“opt-out”). While you may opt-out from such marketing use, you may not opt-out from our use of your email address for transaction processing, non-marketing or administrative purposes such as automatic notifications of recent account activity, or notifying you of major site updates.  Please be aware that we do not support Do Not Track (“DNT”), which is a preference you can set in your web browser to inform websites that you do not want to be tracked.

We may use all of the information that we collect from you to understand usage trends and preferences, to improve the way the website, applications and Solution work and look, to improve our marketing and promotional efforts, and to create new features and functionality.  As part of this process, we may use Google Analytics or other hosting or service providers to provide us with aggregated information about how you and others interact with the website, applications and Solution, and may set cookies and/or use web beacons for this purpose. The information gathered by Google Analytics or other hosting or service providers (including any personal information about you) will be sent to such parties where it will be stored and used by them in accordance with their own privacy policy rather than ours. We may use automatically collected information and cookies information to: (a) remember your information so that you will not have to re-enter it during your visit or the next time you visit the website, applications or Solution; (b) provide custom, personalized advertisements, content and information; (c) monitor the effectiveness of our marketing campaigns; and (d) monitor aggregate usage metrics such as total number of visitors and pages viewed.  We will not use your email address or other personally identifiable information to send promotional or marketing messages except for those specific programs or features for which you will have the ability to opt-out.

Your information, including Personal Information, may be transferred to, and maintained on, computers or in files located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.  If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States and process it there.  Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Only persons age 18 or older have permission to access, use and be ES Members or customers via the Solution.  Our Solution is not to be accessed or used by anyone under the age of 13 (“Children”), and we therefore do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a children under age 13 without verification of parental consent, we will take steps to remove that information from our servers.

Disclosing Information

We may disclose both personally identifiable and automatically collected information to affiliated companies or other businesses or persons to process such information on our behalf, to provide website, applications and Solution hosting, maintenance and security, to offer certain features on the Solution, to assist us in improving the way the website, applications and Solution work and look, and to create new features and service offerings. We request that these parties agree to process such information in compliance with our Privacy Policy.  We also use reasonable efforts to limit their use of such information and request these parties to use other appropriate confidentiality and security measures.  Although we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we receive from you and store in order to protect it from unauthorized access, destruction, use, modification, or disclosure, please be advised that no method of transmission or storage is 100% secure and we are therefore unable to guarantee the absolute security of the information that we have collected from you.

We may share automatically collected and other aggregated non-personally-identifiable information and materials such as mobile device identifying information with interested third parties for their use and distribution for their business purposes, including without limitation for the purposes of assisting them in understanding the usage patterns for certain content, services, advertisements and promotions.  We may share personally identifiable information with other third-party organizations for their marketing or promotional use without your consent, except with respect to any specific program or feature for which you will have the ability to opt-out.

We may disclose your personally identifiable information if we believe, in good faith, that such disclosure is necessary to (a) comply with laws or to respond to subpoenas, court orders, warrants or other legal demands or to establish or defend us from legal claims; or (b) to protect and/or defend: (i) us and our rights or property, (ii) you, or (iii) third parties from fraud, abuse or violations of our applicable agreements with you or from illegal acts; or (c) to protect the safety or integrity of us, the website, applications or Solution, other users, the public and/or other parties as it is deemed appropriate, in our sole discretion. You hereby consent to our sharing your personally identifying information under the circumstances described herein.

If we should ever file for bankruptcy or have its assets sold to or merge with another entity, information we receive from you through the website, applications or Solution is an asset of ours and may be transferred to another party; however, in the event of such a transfer, we will require that the transferee agree to honor this Privacy Policy, as it applies to you prior to the effective date of any such transfer, unless we are legally prohibited from doing so.

Except as otherwise noted in this Privacy Policy, we do not share personal-identifiable information about you with third parties unless doing so is appropriate to carry out a User’s request or we reasonably believe that doing so is legally required or is in our interest to protect property or assert other legal rights.

Third-party Advertisers, Links to Other Sites

We may allow other companies, called third-party ad servers or ad networks, to serve advertisements within the website, applications and/or Solution. These third-party ad servers or ad networks may use technology to send, directly to your browser, the advertisements and links that appear within the website, applications and/or Solution. They may automatically receive your IP Address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize their advertising content.  We may provide personally identifiable information to these third-party ad servers or ad networks except as part of a specific program or feature for which you will have the ability to opt-in. Also, please note that if an advertiser asks us to show an advertisement to a certain audience or audience segment and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they were trying to reach.  You should consult the respective privacy policies of these third-party ad servers or ad networks. Our Privacy Policy does not apply to, and we cannot control the activities of, such other ad servers or ad networks or their websites.

Changes and Updates to this Policy

We reserve the right, at our discretion, to change, modify, add, or remove portions of this Policy at any time for any reason, and we may notify you of such changes through any of a variety of means, including a change to the “Last Updated” date set forth above and other reasonable means to be determined at our discretion. All changes shall be effective immediately. In the event of a material change that may directly affect your account, we will notify you via the most recent e-mail address that you have provided to us in conjunction with your account. Please check this Policy periodically for changes. Your continued access or use of the website, application or Solution after the posting of changes constitutes your binding acceptance of such change.
